Rule 52
Determining the List of Occupational Diseases and Compensation
: (1) The Government of Nepal shall publish a notice in the Nepal Gazette and determine the list of occupational diseases as per sub-section (1) of Section 82 of the Act.
(2) If there is a dispute as to whether or not a worker has contracted any occupational disease as per sub-rule (1), the concerned worker may submit an application to the office to ascertain the same.
(3) If an application is received according to sub-rule (2) or if there is a dispute regarding whether the illness of a worker is an occupational illness or not, the Government of Nepal will form a committee of expert doctors based on the standards of the International Labor Organization and take the necessary decision based on the report received from such committee.
(4) According to sub-rule (3), if any worker is found to be suffering from an occupational disease, determining the amount of treatment expenses and compensation to be given by the employer to such worker and providing such amount shall be as prescribed by the Ministry.
